الفروق الفردية وخطاب التكليف

هداف البحث

يسعى البحث إلى الوقوف على مدى مراعاة الخطاب الشرعي التكليفي، للفروق الفردية، وعلى ما إذا كانت هذه الفروق محلّ نظر واعتبار في الأحكام التكليفية.

منهج البحث

اعتمد البحث المنهج الوصفي التحليلي؛ بتناول عدد من الأحكام التكليفية في أبواب فقهية مختلفة، ومراعاتها للفروق الفردية، في أربعة من مظاهرها.

النتائج

انتهى البحث إلى أن الشريعة قد راعت في الأحكام التكليفية الفروق على المستويات الجسمية، والعقلية، والإدراكيّة حق رعايتها، تحقيقًا للعدل التشريعي بين المكلفين، وأن عدم مراعاتها يدخل الحرج والضيق على المكلّف.

أصالة البحث

تظهر قيمة البحث العلمية في تكريس مراعاة التشريع الإسلامي الفروقَ الفرديةَ، وأنّها مبدأ أصيل فيه، متقدم على النظريات التربوية التي تنظر لذلك وتدعو إليه.

Purpose

This study investigates how the Islamic legal prescriptive discourse considers individual differences and whether these differences are given sufficient observation and consideration in the prescriptive rulings.

Methodology

The study applies the descriptive analytical approach, tackling a number of Islamic provisions in different doctrines and their views of four aspects of individual differences.

Findings

Among the main conclusions of the study, we find that Sharia effectively considers the physical, mental, and cognitive differences in its prescriptive rulings. Such consideration is an aspect of the accomplishment of Sharia justice by legislators. In addition, disregarding these differences would be sufficient cause for legislators to become embarrassed and distressed.

Originality

The scientific value of the study is that we prove that the prescriptive legal rulings consider individual differences and that this process is a genuine principle in Islamic legislation that predated the emergence of the educational theories that advocate it.
